2 Trading Hours
Our telephones are manned Monday — Friday 9.00am — 5.00pm [excluding public holidays]. We aim to return all calls within twenty four hours if ‘answerphone’ messages have been left
3 The Contract between Us
We must receive payment of the whole of the price for the Goods that you order before your Order can be accepted. Once payment has been received by us we will confirm that your Order has been accepted by sending an email to you at the email address you provide in your Order Form. Our acceptance of your Order brings into existence a legally binding Contract between us
4 Purchasing a Hot Tub from Homeless Tubs
4.1 The goods must be paid in full at least 24hrs prior to delivery.
4.2 A deposit paid either by cash or debit/credit card is the only way to reserve your Hot Tub.
4.3 Your Hot Tub will be sold as seen in full working order unless otherwise stated at the time of purchase.
4.4 The deal must be agreed at the time of purchase and noted on your sales invoice.
4.5 All Hot Tubs purchased will be subject to VAT and will be included in the stated price.
4.6 Delivery dates are negotiable depending on availability but will be agreed at the time of purchase.
4.7 Homeless will store your purchased Hot Tub for 4 weeks free of charge from the date of sale. After this point storage is charged at £20 per week + VAT
5 Selling a Hot Tub to Homeless Hot Tubs
5.1 All initial sale prices agreed will be confirmed by email.
5.2 Final sale price agreed will be displayed on collection note or sales invoice and signed by both parties.
5.3 Homeless Tubs will hold the seller blameless for any damage or non-working parts from date of collection.
5.4 Homeless Tubs will be the new owners of the Hot Tub upon completion of the sales transaction.
5.5 The seller is not able to reverse their decision once the Hot Tub is removed from the property.
5.6 If a collection is cancelled with less than 24hrs notice a cancellation fee will apply of £250 + VAT except for exceptional circumstances.
6 Your right to cancel your contract
You are able to cancel your contract anytime up until 24hrs before delivery without the need to give a reason. 10% of the agreed sale price will be deducted from any deposit returned to cover losses and administration fees.
7 Delivery to you
7.1 The buyer is responsible to ensure that the site is ready to accept delivery as per our pre-delivery instructions that will have been mailed to you prior to the delivery date. Please pay special attention to access, electrical requirements and the base for which to site your Hot Tub on.
7.2 A failed delivery due to insufficient access may result in your Hot Tub being left with you so that you can find an alternative way to compete the siting. If we have to take the Hot Tub away with us you will be charged for a re-delivery.
7.3 A failed installation due to faulty electrics or improper base to site your Hot Tub will not fall to the responsibility of Homeless Tubs. Homeless Tubs will use their best endeavour to hand over the Hot Tub on the day. If a further visit is needed doe to this reason then this will be chargeable as per our standard breakdown fees.
7.4 On completion of the installation the customer will be shown some basic maintenance guidance to help prolong the life of the Hot Tub and promote cleanliness. The customer will also be shown how to treat the Hot Tub water with chemicals as per the industry standards. It is then the responsibility of the customer to maintain safe bathing water at all times to prevent the spread of harmful bacteria.
8.1 With every second hand Hot Tub sold, Homeless Hot Tubs will provide a limited 6 month parts and labour warranty from the date of installation provided that it is delivered within 4 weeks of the sale date. The warranty period will reduce accordingly if the Hot Tub has not been accepted for delivery within 4 weeks of the sale date.
8.2 Homeless Tubs will be permitted to use new or refurbished parts to carry out repairs as long as they are of at least equal condition to the components that are being replaced.
8.3 If the Hot Tub is beyond economical repair which is not a fault of the customer, within the 6 month warranty period and a solution cannot be found; Homeless Tubs will replace the Hot Tub with something from their stock range of equal value. The 6 month warranty period will be renewed from the date of delivery of the replacement Hot Tub.
8.4 If a Hot Tub does need to be replaced under the terms of the warranty but Homeless Tubs don’t have a suitable replacement in stock within a 3 month period, Homeless Tubs will offer a partial refund based on the circumstances.
9 Privacy and Personal Details
Whilst we aim to deliver the very best services we can and we will happily listen to any complaints you may have, we would urge you to write to us or email us to ensure your complaint is backed up in writing before or after you telephone us.
11 Governing Law
The Contract between us shall be governed by and interpreted in accordance with English Law and the English Courts shall have jurisdiction to resolve any Disputes between us
